At the Law Offices of Sherin Thawer, P.C., we offer our services to those who are in need of any assistance with the immigration issues.  One of our latest success stories is about a Client named Mr. Naseer Bagga (name changed to protect Client’s identity). The Client is a 59-year-old citizen of United States who wished to adopt his orphan nephew from India. On January 12, 2008,  through the assistance of his prior attorney, he filed Form I-600, Petition to Classify Orphan as Immediate Relative, seeking to classify his nephew for benefits under section 201(b) of the Immigration and Nationality Act.  On January 14, 2008, the petition was received by USCIS, but on or about January 27, 2008 the file was returned because it was sent to the wrong address. By the time prior attorney corrected his mistake, and sent the petition to the proper address, the beneficiary reached the 16 years of age. Consequently, on or about November 13, 2008, USCIS denied the aforementioned petition for the following reasons: (i) under Title 8, Code of Federal Regulations, section 204.3 (a)(1)(i), the term “child” means “under the age of sixteen at the time of a petition is filed”, (ii)  the petition was denied because Service records indicate that the beneficiary was born on January 16, 1992 and the petition was received on January 30, 2008.  In sum, the Service denied the application under 8 C.F.R. 204.3 (a)(1)(i) due to beneficiary having reached the age of 16 preceding the receipt of the application.

Then, Mr. Bagga retained Ms. Sherin Thawer who immediately filed motion to reopen and compel the USCIS to reopen the case and properly adjudicate it, and issue a decision thereon.   As a result, the case was reopened but the USCIS insisted in providing them with a “No Objection Letter” from the CARA (Central Adoption Resource Agency). Same was obtained with great difficulties from India and Mr. Bagga’s application was adjudicated in his nephew’s favor after long there (3) years and by means of devotion and commitment from Ms. Thawer.

At the Law Offices of Sherin Thawer, P.C., we offer our services to those who are in need of assistance with any of the immigration issues.  One of our latest success stories is about a Client named Mr. Alien Entrepreneur (here the name is fictitious to protect Client’s identity.)

Mr. Alien Entrepreneur had been placed in the deportation proceedings and was ordered by the Dallas Immigration Court to voluntarily depart the United States by June 16, 2011. Mr. Alien Entrepreneur did not wish to return to his home country as he has been well established business owner with property, residence and family and well settled in the United States for years.  Mr. Alien Entrepreneur was at his wits end, when a friend suggested him to visit Ms. Sherin Thawer. Immediately, entered into negotiations with US Immigration and Customs Enforcement (USCIS) attorneys and was able to have government’s attorneys to agree to terminate deportation proceedings. The morning of June 14, 2011, Ms. Thawer filed a Joint Motion to Terminate Voluntary Departure and Motion to Stay Deportation Proceedings, and in the evening the Honorable Immigration Judge granted the order to terminate and order to stay for benefit of Mr. Alien Entrepreneur. As a result, Mr. Alien Entrepreneur’s case was reopened and his deportation proceedings stayed, for further hearing and review.

This welcome decision opened doors for Mr. Alien Entrepreneur to obtain Lawful Permanent Residence in the United States and proceed with filing of the I-526, Immigrant Petition by Alien Entrepreneur an immediately available investor visa.

Mr. Mohamed Rahman and his spouse, Ms. Munawar Fatima Rahman, have retained the Law Offices of Sherin Thawer, P.C., to assist in their filing of their N-400 Applications for Naturalization. Although Mr. and Mrs. Rahman had completed five (5) years of lawful permanent residence in the United States, their case had a complication because Mr. and Mrs. Rahman had overstayed their visit due to work schedule and various medical emergencies in the last five (5) years. However, with the assistance of the team at the Law Offices of Sherin Thawer, P.C., and an accurate justification and evidence submitted to the USCIS, Mr. and Mrs. Rahman, received their interview notices concerning their citizenship application in less than four (4) months. Abraham family arrived to United States with their daughter and since have became U.S. Citizens; however, their daughter, Nazima, a citizen and national of Pakistan,  born with Cerebral Palsy and suffering from both mental and physical defects, was found ineligible for a visa as a derivative of her mother by the U.S. Embassy in Islamabad.  Embassy determined that she had aged out.  Ms. Thawer has reviewed the file, history and the applicable laws and determined immediately that said conclusion was an improper determination under the Child Status Protection Act.  Ms. Thawer filed a comprehensive memorandum in support of Nazima’s Adjustment of Status and despite her current unlawful status pursuant to code provisions that provide an exception for failure to maintain lawful status through no fault of the non citizen or for technical reasons.  Alternatively, Ms. Thawer pled that Nazima was eligible for adjustment on the basis of her derivative status under the previously filed petition on behalf of her mother, which renders her a grandfathered alien for purposes of adjustment under I.N.A. § 245(i). In addition, Ms. Thawer presented special equities which merited a favorable exercise of discretion.  (These included the total physical and mental disability of Nazima and the extreme medical and financial hardship which would have resulted to her U.S. citizen parents if adjustment was not permitted.) Stressing the fact that the punishment was well out of proportion for failure to maintain lawful status and that same should not be inflicted on this long-suffering family, Ms. Thawer succeed, and the Service permitted adjustment under the exception to lawful status and granted Adjustment of Status under I.N.A. § 245(i).

Mr. Mahbub Chintamani , a United States Citizen, has filed an I-130, Immigrant Petition for Alien Relative for his brother, Mr. Jaminal Chintamani . The Field Office Director instructed Mr. Chintamani to submit additional evidence in support of this petition within forty-eight (48) days. Subsequent to submitting additional evidence, the Field Office Director denied the petition on grounds of insufficient evidence.

Mr. Chintamani  hired the Law Offices of Sherin Thawer P.C. to file an appeal against this inequitable decision. Ms. Sherin Thawer filed a comprehensive appeal with the Board of Immigration Appeals (BIA) and promptly sent a notice to the United States Citizenship and Immigration Services (USCIS) regarding the same. Based on the well thought-out legal strategy, abundance of essential case law supporting same, and attached evidence, the USCIS considered the appeal. As a result, the USCIS reopened Mr. Jaminal Chintamani ’s case and forwarded for further consideration. The successful appeal have a great opportunity for the two brothers to undergo DNA testing to prove their sibling relationship; the evidence which was initially missing and fatal in USCIS’ determination first time around.

At the Law Offices of Sherin Thawer, P.C., we offer our services to those who are in need of any assistance with the immigration issues.  One of our latest success stories is about a Client named Mr. Buddha Chaterjee. Mr. Chaterjee entered the United States on a F1 student visa. On account of some financial constraints, Mr. Chaterjee was unable to fund his education, and as a result, the Designated School Official (DSO) at his school, revoked Mr. Chaterjee’s Student and Exchange Visitor Information System (SEVIS) I-20, Certificate for Eligibility of a Non Immigrant Student.To earn a living, Mr. Chaterjee started to drive cabs in Dallas, Texas area and on an unfortunate occasion, was picked up by the law enforcement on charges of DWI (Driving While Intoxicated). The law enforcement agencies reported him to the US Immigration and Customs Enforcement (ICE). The ICE placed an immigration hold on Mr. Chaterjee’s ability to obtain a bond. ICE hold deprived Mr. Chaterjee the right to post a bond pending trial on the merits and his ability to be released from Dallas County’s detention. At such time, Mr. Chaterjee was left with only two choices: voluntarily return to his home country, i.e. Nepal or remain in jail facility until the time of trial. However, Mr. Chaterjee did not desire to return to Nepal. On the other hand, if he was found guilty at trial, he would have been deported, losing his right to freely return to United States. With the assistance of the Law Offices of Sherin Thawer P.C., Mr. Chaterjee’s “ICE hold was removed, and Mr. Chaterjee was released from detention. Also, Ms. Sherin Thawer ensured that no negative consequences incurred on Mr. Chaterjee’s future immigration endeavors into the United States.

Mr. Bissonchand Beharry contacted our offices since he had not received an appointment in years for a permanent residency interview.  Ms. Lana Sue Beharry, Mr. Beharry’s wife who is a United States Citizen filed petition on behalf of her husband. The Dallas Field Office of USCIS had isolated Mr. Beharry’s file for an extensive officer review. USCIS sought additional fingerprints from Mr. Beharry which further delayed processing of his Form I-485. A Notice of Intent to Deny was issued regarding Mr. Beharry’s greencard petition. USCIS officials also doubted the bonafide nature of Mr. Beharry’s current marriage and sought to confirm their allegations that Mr. Beharry continued to live with his ex-wife.  Ms Sherin Thawer immediately sprung into actions: performed an Infopass inquiry with the USCIS and, as a result, Mr. Beharry’s fingerprints were cleared and case was transferred to the National Benefits Center. Ms. Thawer also sought the services of a private investigator and gathered sufficient evidence to convenience USCIS officials that in fact the allegations that Mr. Beharry and his ex-wife were still living together were bogus. Ms. Gurjeet Hanspal’s husband, Mr. Mahip Singh Hanspal, had an I-485, Application to Adjust to Permanent Resident Status pending with the U.S. Immigration and Customs Enforcement when Mr. Hanspal was charged with second Driving While Intoxication (DWI) Misdemeanor and placed under arrest for a week. US Department of Immigration and Customs Enforcement (ICE) also placed an immigration hold on Mr. Singh’s ability to obtain a bond. ICE hold deprived Mr. Singh’s right to post a bond pending trial on the merits and his ability to be released from Collin County’s detention. On the other hand, if he was found guilty at trial, he would have been deported, losing his right to freely return to United States. Mrs. Ferdous’ I-140: Immigrant Worker Petition for Employment Based Green Card was revoked by her employer. Subsequently, she filed her AC21 under the American Competitiveness in the 21st Century Act (AC21) which permits an individual to seek new employment and change of jobs before I-485 (Green Card) is approved. Then, she filed her I-485, Application to Register Permanent Residence or Adjust Status, but same was denied by the Citizenship and Immigration Service office. The Law Offices of Sherin Thawer, P.C., filed a MOTION TO REOPEN because the American Competitiveness in the 21st Century Act (AC21) permits an individual to seek new employment, inter alia, if his/her I-485 has been pending for at least 180 days. Ms. Thawer prevailed on the motion and the USCIS resumed adjudication of Mrs. Ferdous’ I-485. Because the priority date was current Mrs. Ferdous obtained her green card immediately.

However, the USCIS failed to reopen Mrs. Ferdous’ husband I- 485 who was a beneficiary of her application.   Not until Ms. Thawer filed an ORIGINAL COMPLAINT FOR WRIT IN THE NATURE OF MANDAMUS action in Federal Court in Northern District of Texas against all six (6) agencies – United States Citizenship and Immigration Services, Department of Homeland Security, Federal Bureau of Investigation, et als, that Mr. Naim received his I-485 approval.
